What Is an ACP-5?

An ACP-5 is a New York City DEP asbestos filing used for DOB permit applications. It confirms that a certified asbestos investigation was performed for the planned construction scope. ACP-5 filing applies only to New York City projects. For Long Island, Westchester, and other New York State projects, asbestos inspections may still be required, but ACP-5 filing is not used.

How long does an asbestos inspection take?

Most residential inspections take approximately 1 to 3 hours on site, depending on property
size, access, and the number of suspect materials

An ACP-5 asbestos assessment report is generally required by the NYC Department of Buildings when a construction or renovation job requires a DOB permit. An NYC DEP-certified asbestos investigator must inspect the project work area and file the appropriate asbestos documentation before DOB can issue the permit.

No. ACP-5 is a New York City DEP filing. However, asbestos inspections may still
be required for renovation or demolition work outside NYC.

Yes. Although asbestos is more common in older properties, asbestos-containing materials may also be present in newer buildings. A New York State asbestos survey is generally required before renovation, remodeling, or demolition in buildings constructed before January 1, 1974. In New York City, buildings constructed under plans approved on or after April 1, 1987 may qualify for an NYC asbestos exemption; however, known or suspected asbestos materials must still be properly evaluated before disturbance. Federal EPA asbestos inspection and NESHAP requirements depend on the building type and scope of renovation or demolition, not solely on the building’s age.
